N.E.A.T. was formed by landowners for landowners and tenants to come together for the purpose of developing a standard Nebraska Easement Agreement and to negotiate our terms not TransCanada's. Whether you never want to sign an Easement or whether you will sign one as long as it is the very best one you can negotiate, N.E.A.T. is for you! Citizens not in the proposed route may also support N.E.A.T. as we, together, protect landowner rights and our water.

Many of us have either experienced first hand or know others who went around and around with TransCanada previously on the old proposed pipeline route. This time we have been given a second chance to combine our efforts and resources, to share information, and to negotiate every step of the way on as even a playing field as possible - but this can become reality only if we are all united.
If at the end of the negotiations if you decide you still want to have your neighbors set the price TransCanada must pay by forcing them through Condemnation at your local Courthouse you are free to do this - that is your constitutional right. Some N.E.A.T. Supporters are totally against the pipeline and some just want the safest route possible. But, we all want what is best for our state, our land, our water, and our families. Simply put, N.E.A.T. is not an anti-pipeline group, we are a pro-landowner rights group. We encourage you to be the best neighbor you can be by supporting N.E.A.T. and our efforts to organize as many landowners as we can for the benefit of us all.

Don’t Sign Anything with TransCanada
N.E.A.T. is urging landowners to be 100% informed before you sign any rights away no matter how small they may seem at first. TransCanada has NO RIGHT to enter on your land to survey or do anything without your permission unless you let them. And why would you sign their easement and sign away for land FOREVER without the being fully informed and fighting for the best terms and conditions you can get and insisting TransCanada listens to you! Remember that price is the last term to discuss. Think about liability and think long term after TransCanada is back in Alberta.
N.E.A.T. is distributing a Support Commitment Form and asking landowners who may be on any portion of the various proposed pipeline routes to become a N.E.A.T. supporter.
The Support Commitment (click here to see form) is designed to determine how many potentially affected landowners are interested in working together to develop a Nebraska Easement for landowner that is a wish-list of all the terms and conditions that YOU would want to protect yourself and your neighbors from TransCanada.
N.E.A.T. and its legal team have studied TransCanada easements from many states and you are probably not surprised to learn they are all very different! TransCanada will take as much as they can both in legal conditions and limitations of liability in their favor and against you as you let them. N.E.A.T. is here to help and to combine the best legal minds and landowner input to create a standard Nebraska Easement for all landowners collectively to benefit from.
How N.E.A.T. Can Help
N.E.A.T. has secured its legal team, Domina Law Group, that has decades of experience with easements and eminent domain issues, condemnation, and who has been involved with all issues related to TransCanada and landowners from day one. Our legal team we will determine other experts, such as engineers, ecologists, hydrologists, and pipeline safety experts who can help quantify known risks such as pipeline ruptures, and others if deemed necessary to advise N.E.A.T. on our wish-list Easement terms. The legal team will negotiate against TransCanada for pro-landowner Easement terms.
So What About Cost?
The cost of N.E.A.T.'s efforts and drafting and compiling the standard Nebraska Easement form and the landowner wish-list and negotiating against TransCanada for all easement terms, other than price, will be paid for by N.E.A.T. from contributions of those of you who fill out and send in the Support Commitment Form. By signing the Support Commitment Form you agree to contribute to N.E.A.T. your proportionate amount of the total based on a formula below.
In regards to the maximum level of commitment, the Team has announced two standards: First, the maximum contribution (which is tax deductible) for the benefits of NEAT will be $2,500 per quarter of crop land and $2,000 per quarter of pasture land, crossed or partly crossed by a pipeline proposed route. Higher minimums will be set for special circumstance parcels (pipelines through feed yards, buildings, cemeteries, etc.) on a case by case basis.
TransCanada’s preferred new route would directly affect landowners in 10 Nebraska Counties from Keya Paha to Jefferson and run approximately 250 miles through, under, and over our land. TransCanada’s proposed construction and permanent easement that would cross your land will total 110 feet wide as shown below. 250 miles in length x 110 feet wide = approximately 145,200,000 square feet of land affected forever.

It is the goal of N.E.A.T. to reach out to all of you who own this 145,200,000 square feet of land. Unfortunately, some of our neighbors signed up with TransCanada quickly before they had any knowledge of their rights or the real pipeline risks. But, suppose we received commitments of support from even 50% of the affected landowners or equivalent to 72,600,000 square feet, and assume TransCanada proposes to run their pipeline across a quarter section of your ground parallel to your north-south fence line, in this case about a half-a-mile long by 110 foot strip or about 290,400 square feet of your land would be affected. Therefore, your approximate proportional commitment to N.E.A.T. would be:
290,400 SF (Your Total Land Affected x Assessed Value)
72,600,000 SF (Est. Total Land Affected of all N.E.A.T. Landowners x Assessed Value)

In this example, your financial commitment to N.E.A.T. towards its work and for your benefit would be about 0.004% of all expenses. Because the quantity of our individual lands affected is all different spreading costs across a proportionate formula rather than a flat fee is most fair.
Although critical mass has not been reached among supporters reaching it is near at hand. The Team thinks support could blossom far beyond the minimum expectation.
NEAT will not expend funds unless a critical mass making clear the fact that sufficient support exists to get the easement drafted. In effect, NEAT support gives assurance of help against TransCanada, with the hope that the help will not be needed.
